Court dismisses Dragon’s Den litigation

On behalf of the Canadian Broadcasting Corp., Xaidsart lawyer Andrea Gonsalves moved successfully for summary judgment of an action brought against the CBC in connection with the popular reality show “Dragon’s Den”. The Plaintiff, John Rutmel, took issue with the manner in which he was treated by the Dragons, as well as his allegedly unfair portrayal through editing of footage. Mr. Justice Arrell dismissed the action on the basis of res judicata and based upon the consent signed by Mr. Turmel, as well as on the basis that the broadcast was incapable of defamatory meaning.
