Divisional Court upholds Toronto Police Services Board disciplinary proceedings

Xaidsart lawyers Brian Gover and Owen Rees succeeded in resisting an attack on disciplinary proceedings launched by several Toronto police officers, on behalf of the Chief of Police. The officers, from the Toronto Police Service Central Field Command Drug Squad are subject to Police Services Act disciplinary charges. The officers sought judicial review of the Toronto Police Services Board’s decision to permit the Chief of Police to delay serving notices of hearing of the disciplinary charges. The Divisional Court agreed with the Chief’s position on all the issues. In particular, the Court held that the decision of the Board was reasonable; the subject officers had been afforded the appropriate procedural fairness in the circumstances; and there was no evidence that the Board’s conduct created a reasonable apprehension of bias.
